Terms & Conditions: Pre-Authorized Debit (PAD) Agreement

Definitions

• “Payor(s)” means the Parent / Guardian who is the Bank Account / Joint Account Holder(s) authorizing this debit.

• “Payee” means the childcare service provider authorized to debit “Fees” for Goods and Services. The Payee is a subscriber of esiKidz Childcare Management Software. The Payee’s full legal name and contact information are provided by the childcare service provider.

• “Fees” refers to the monetary value in Canadian Dollars defined by the “Payee.”

Software Disclosure & Liability

“esiKidz” is the software provider facilitating payment processing on behalf of the “Payee.” esiKidz is not a party to this PAD Agreement. Any disputes regarding “Fees” or childcare services are the sole responsibility of the “Payor(s)” and the “Payee.”

Authorization

As a “Payor(s)”, I / We hereby authorize:

• The “Payee” and my/our financial institution to process Pre-Authorized Debits (PAD) against my/our account on or after the day of each month defined by the “Payee” for all relevant “Fees” in accordance with this agreement.

• I/We warrant that I/we have the authority under the terms of my/our account agreement to authorize this debit.

• This authorization is provided for the benefit of the “Payee” and my/our financial institution.

Waiver of Pre-Notification

I/We agree to waive the 10-calendar-day pre-notification requirement for changes in the amounts and/or payment dates of Pre-Authorized Debits drawn against my/our account.

I/We acknowledge and agree that variable amounts may be debited as determined by the childcare services provided by the “Payee.”

Cancellation & Withdrawal

• How to Cancel: I/We may revoke this authorization at any time by providing written notice to the “Payee” or by contacting my/our financial institution. Cancellation of this PAD Agreement does not automatically terminate childcare services or other contractual obligations with the “Payee.”

To obtain a sample cancellation form, or for more information on my/our right to cancel a PAD Agreement, I/we may contact my/our financial institution or visit www.payments.ca.

• Child Withdrawal: Formal withdrawal from the childcare program requires a minimum of 60 days’ written notice to the Administration office prior to the last day of the month. Failure to provide notice may result in fees in lieu of notice, as determined by the childcare service provider’s policies.

Recourse Rights

I/We have certain recourse rights if any debit does not comply with this agreement. For example, I/we have the right to receive reimbursement for any debit that is not authorized or is not consistent with this PAD Agreement.
